Photography contracts

Hi Everyone,

We are in the process of booking a photographer and find some things in the contract that are a bit concerning.

We agree with tagging the photographer on any online sharing etc... but has anyone had things such as paying for your photographer if they have technical issues and are unable to provide any photos ie: computer issues at time of upload; or not allowing any guests to have or use cameras while the photographers are there? Another concern is if they are ill and are unable to attend we only have our deposit returned?

Thoughts?

    Thank you. The photographer was amazing and for what he did for us. The timing was unlimited being part of the package and the fact he did bring a second photographer no extra charge.

    Photographers along as any vendors are to provide service for your wedding. They are responsible for making sure they show up and get everything to you at the end of their editing and proofing of the pictures. They don't show up for the day of the wedding, they are legally in the right to give you a refund for not giving the service as promised.

    Ask questions as needed to feel reassured for yourselves and les stressed. Another thing you may want to do for payment is to break it into 3 parts. The deposit required to pay up front, the second portion the day of the wedding, and the last once you receive the finished photos on a usb.flash drive if not choosing to get a photo album done. Most vendors do make it a 2 part payment for their contract basis.

    That, to me, translates to:

    "In the event I decide to not do a thing at your wedding but eat your food and drink at your open bar, I'll just tell you my SD card got fried and you still have to pay me. Sucker."

    I would hard pass on this photographer and leave a review accordingly stating such contracts stipulations.

    All the photographers I know through theatre and events have insurance for this purpose. The photographer is responsible for their equipment and photo storage/transfer, that is not your responsibility to cover them for that. Even in a "1% chance".

    That is a major red flag for me.

    I certainly don’t want to miss out on wedding photos completely, the risk albeit a small one is possible as we are in a technical world. If the guests aren’t permitted cameras and their systems don’t function it would be devastating.... to say the least. It’s not like you can redo your wedding photos on another day....

    Hi Hank, as always you are a wealth of knowledge. The contract specifically states “in the 1% chance of any technical issues on our part you are still required to pay for our photographers time.”

    I would ask for clarification - maybe there's a misunderstanding. Only because I have a really hard time believing someone can have the gall to say you have to pay them if they break their own equipment while sending you photos. Of course, if that's the actual clause then it's extremely sketch but I would double check.

    Usually photographers do stipulate not having other photographers join on the shoot for a particular event to avoid conflict and if you need a second shooter, the photographer will procure one. They will sometimes also stipulate that they are not to be held responsible for bad shots due to unruly guests (ie if your photographer positions themselves to shoot the first kiss and one of your guests jump in front of them with a giant ipad and got in the way, that shouldn't be on them). But to stipulate that all guests not be allowed to take a single photo throughout the entire contracted service period is not only unenforceable but impractical.

    Definitely double check with them about the contract terminology and ask for a rephrase if it makes you more comfortable.

    I personally see this as a red flag! I would not hire them at all. Not being able to get your money back or even someone else to come and do the photos if they get sick is crazy talk!!

    Completely agree with Brittany. You should not be hiring them. In our contract, if they could not make our wedding, they were to find us a replacement or refund us entirely.

    Oh no, that does not sound great at all.
    Definitely need to bring it to their attention that you’re uncomfortable with those issues mentioned.I agree with Brittany!!

    Those three points you mention are extremely concerning. I would negotiate the contract and say you are not comfortable with these points and that unless you guys cannot come to a solution you may have to go an other route.

    I recently got my engagement photos done and did not have any of those things mentioned.

    Why are technical issues on her gadgets something you would have to pay for? That does not make sense - if anything they should reimburse you for not being able to provide any photos and fulfill her end of the contract.

    Also it is nearly impossible to tell guests that they are not allowed to use their phones during an 8 hour time period they are at the wedding? That is ridiculous.

    And again, if you signed a contract and THEY terminate it - they have to reimburse you the FULL amount of what you paid. I just signed a contract with The Whitewood Barn and they put if there is a reason the providers themselves cancel the event they reimburse us the entire amount we have paid so far.

    So no, this sounds sketchy and I would not hire this person.

    Side note-I have taken a contract law course during my business degree - and all these things mentioned are ridiculous and it sounds to me that this vendor may try to cancel their event time they booked with you or screw you over with the contract they have written up.
