Photographers & contracts

Phaidra, on July 14, 2018 at 15:00 Posted in Plan a wedding 0 7
Hey lovely humans,
I'm looking for advice and knowledge about wedding photographers and their contracts. I have no experience with this and am hoping I can learn from you!
We put out a request for a contract from a super talented photographer and it was super legaly and kind of intimidating. It basically sounded like we couldn't share our photos online or crop anything, and they were providing us the rights to use our photos as is. I understand that they have the ability to use our photos and such as they see fit, and need to protect themselves, but it was just a bit scary.
We've sent back the contract and asked for some clarity.

What was/is your experience with your wedding photographer and their process of contracts, etc? Are you a wedding photographer? What's your process?

As a photographer myself, contracts are used to help set boundaries for their rights and their clients. Basically what it sounds like is that they just want to preserve the integrity of their work. Since Photography is a creative art, all the images that are produced are a reflection of their creative vision and composition. So by adding in their contract that the photos cannot be re-edited or cropped or filtered,etc.. is very standard. If a client goes in crops, and re-edits their photos it means to them that you don't like what they have created for you. Also if you are posting those changed images online its not a true representation of them, which could negatively impact their business.

I am very open with my clients about my creative process and i am also open to revisiting and finding ways that the images that i create can best suit my clients. So ask your photographer if they are open to revisions, most generally are if it means that they can still ensure that you are happy with their work and it still is true to their creative style. if they are not then id say move on and find a photographer who will work with you and be just as considerate of your style.

When choosing a photographer for our wedding, we chose a wonderful woman who had the style and composition that we loved, so we knew that we were all on the same page. Our engagement photos turned out wonderful and she was great to work with. Always, Always ask for clarification if you are concerned. In the end you are entrusting someone to capture all of those great moments throughout the day, make sure they are a good fit!

Our photographer emailed me an e-contract. It's pretty basic, yes, it explains she owns the photos, meaning she can do what she wants with them (mostly using for her own promotion on social media, doesn't need to check with you before posting pics on Instagram)... but it also means we cant sell them or profit off them. Nothing extreme like needing to pay her extra to have them on invites or on our wedding site.
Ask for clarity for sure... it shouldn't sound like a trial case document. It's for the average person, it shouldn't sound like it is written by a lawyer for a lawyer.

My photographer also sat down and outlined our contract with us, she does technically own the pictures but said basically we need to get her permission if they’re going to be used say in a magazine or something like that. I heard a horror story about a couple who got engagement photos and almost got a printing company sued for creating invites with the pictures.. definitely ask for more clarity. My photographer assured me that she isn’t that crazy! She just wants the credit for her pictures.

Are they keeping the rights to your pictures? You get to do whatever you want with them at the end when received.

I wouldn't sign the contract unless your willing to take that risk. We didnt have that rights on the contract.

The only thing our photographer told us is we could notify him if we wanted an album made and what pictures to send him.

Our photographer sat down and went over the entire contract with us prior to signing it. She answered any and all questions we had about the legal terms and she even made notes on the contract in places that got confusing. She was fantastic about it
