"Acts of God" Clauses in Wedding Contract

Hi everyone! Hope all is well.


I am in the midst of looking at venues and while reading the fine print of contracts presented, I noticed clauses that essentially dictate that natural disasters and pandemics (so Covid included I imagine) are grounds for the venue to reserve the right to cancel as they see fit...not just postpone but fully cancel and keep your whole 50% deposit!!! Which can be literally thousands of dollars that venues can take from you without having to follow through with giving you the contents of the wedding plan outlined in the contract. I am super uneasy about this - as much as I love some of these venues, I obviously cannot risk losing several thousand dollars if Covid decides to stick around or resurface in the next couple of years. Has anyone come across this and if so, any advice on how to negotiate terms or work around this type of contract clause?

    Okay, yeah I understand what you mean. I'll definitely keep an eye out for lines like that now that I know what to look for. Just glad I caught it and got some advice on it! Yeah, it is definitely unfortunate, but not worth the potential huge headache it could cause for sure. Thanks again!

    No worries, glad I could help. But what I'm saying is just in general terms. Please review all your written contracts with a fine toothpick. If your contract actually says something along the lines of "All funds paid is non-refundable even in the event of an Act of God, pandemic, etc etc etc, whereby the owner reserves the right to cancel the event without liability," walk away. Regardless of how much you love the place, they're clearly a shady business and it's not worth the potential hassle.

    Thank you very much for your detailed and thoughtful response! I'll surely be staying away from the venues you mentioned! It is good to know that these clauses typically should result in refunds should a venue cancel on us or otherwise legal action would likely still be possible. Thank you for the advice - seeing as other venues have been fishy, I'll be making sure to negotiate any terms that fail to protect our deposit. Hopefully not all venues have these covid clauses now or I guess I'll be waiting a while to book!

    I can't be absolutely certain without reading the details of your specific contracts, but based on experience, cancellation via Acts of God usually result in a refund. Refunds are usually not honoured if you cancel on them for any reason.

    A lot of venues tried to strong arm their clients into not accepting a refund (Dynamic Hospitality), charging for date changes (Peter and Pauls) or just outright refuse to refund and postpone (Bellvue Manor) during the early months of the pandemic and likely ended up getting sued or got a ton of negative media attention on them. If what you're saying is true about the new terms, it sounds like these fishy people are looking for ways to pocket your money like Bellvue did.

    Do know that if a contract is frustrated and one party refuses to honour refunds as a result, it's ground for some major legal action.

    You can certainly negotiate the terminology of the contract to better reflect your stakes in the deal and if they refuse, walk away and take your business elsewhere.
