Wedding photos over 1.5 months late

Need guidance on how to navigate our photographer being late with delivering our photos. In the contract, it states estimated date of delivery is 3 months past the wedding. She promised us it would be no more than 2 weeks past the 3 months, if necessary.


It has been almost 1 month and 3 weeks late at this point. Whenever I had followed up for updates, she would say, “just putting the finishing touches” or a “few days more” for over 1.5 months. Her dog was unwell so we give her grace for that but she is constantly posting other family’s photos and friend outings on her instagram.
She was delightful to work with at our wedding and I’m sure the photos are beautiful but we are getting upset with the empty promises. Should we ask for a partial refund at this point? We don’t even care about a refund but I’m wondering if this might get us to be treated more like a priority. She was expensive to hire and we had to pay on time, no exception. She is relatively unresponsive and only updates that she needs more time when I email her that this is stressful. She never takes initiative and requests more time from us.
