Venue cancelled wedding; not refunding deposit

Hi!


I got the worst news last night… my venue (which I booked back in 2021) is basically bankrupt and are now saying they are not sure they will be operating by my wedding (Sep 30 2023). So basically they are not “canceling” but they are also not giving me other option since it’s not guaranteed my wedding will happen.
On top of that, they are not giving the $9k deposit (venue fee) back, because that money is gone. The contract says it’s non-refundable but it only talks about in the event of us canceling it, not them.
I have a letter from them basically saying they are aware of the deposit but the assets were transferred to a court-appointment receiver, and that money was long gone.
I am freaking out! I was able to find a few venues with avails the same day or day before (I can’t postpone it as I have out of town guest who have already bought tickets) but we needed this deposit money back so much! It’s not fair for them to keep it since they are the ones cancelling on us!
Anyone has gone through this? Any tips on what we could do?

    I am so sorry to hear that, that is the worst experience to have to deal with especially so close to the wedding. Hoping something positive will happen for you.

    We called the bank yesterday too but since the payments were done via etransfer, they can’t revert or dispute like a credit card charge. The venue didn’t accept credit card for the deposit so we didn’t have a choice…
    Unfortunately we are starting to “accept” the money is gone… but it’s just so hard to start from scratch 7 months prior and without this deposit money.We are now even considering having a small city hall wedding and host a lunch/dinner, and then elope during our honeymoon.

    Geesus I am so sorry this has happened to you; I am hopping this has happened to someone and they could guide you. Not sure there is anything you can do. Maybe reach out to your bank if you have a receipt of the deposit and proof the money came out of your account, they might be able to guide you, they will for sure know what can be done when a company goes bankrupt.

    Hope everything turns out for you in the end.

    Omgsh, I am so so sorry this has happened to you and it is mind blowing you are being told you are out the 9k! I have heard of situations like this before when a company goes under and basically everything is out of their hands and appointed to courts...

    I have not experienced this and am not sure what tips to offer but I am hoping someone on here can help and I am so sorry but trust the process and try not to let it ruin what is suppose to be a magical time Smiley heart Smiley heart
